Terms of Service

Agreement to Terms
These Terms govern your use of the Tuizee application and related services (the “Service”) operated by Digiconsult Ltd, a New Zealand registered company (“Tuizee”, “we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.
Definitions
- “Workspace”
- means a subscription unit owned by a Business Owner or Sole Trader
- “Business Owner” or “Sole Trader”
- means the person who creates a workspace and is responsible for billing
- “Team Member”
- means any user invited to a workspace, including tradespeople, employees, and contractors
- “Customer”
- means a person who receives a secure link to view job information but is not a formal user
- “User Content”
- means all data, documents, photos, job records, and materials uploaded to Tuizee
Eligibility
You must be 18 or older to use the Service. We don't verify age by ID, but if we learn someone under 18 has an account, we'll terminate it.
Your Account
- Keep your credentials secure
- You're responsible for all activity under your account
- Notify us immediately of any unauthorised use
When you invite Team Members, you represent that you have authority to do so and are responsible for their use within your workspace.
Free Trial
We offer a 2-week free trial with limits: 1 user, 3 active jobs, 10 total jobs. No payment information is required. We may modify or end the trial offering at any time.
Subscriptions and Billing
- Subscriptions are billed per workspace, monthly in advance
- Tiers provide different numbers of team seats and features
- Prices are in NZD and include GST
- Payment is via Stripe or direct NZ bank automatic payment
- Subscriptions renew automatically unless cancelled
- You can cancel at any time; cancellation takes effect at the end of the billing period
- No refunds for partial billing periods
- We may change prices with 30 days' notice
- Failed payments may result in suspension after 7 days
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that is illegal, defamatory, or infringes others' rights
- Upload photos of individuals without consent where required
- Share customer secure links with unauthorised persons
- Attempt to access other workspaces' data
- Reverse engineer or disrupt the Service
- Resell or sublicense the Service without our consent
User Content
Ownership
You own your User Content. Tuizee doesn't claim ownership of it.
Licence
You grant us a non-exclusive, royalty-free licence to host, store, transmit, and display your content solely to operate the Service.
Your responsibilities
You are responsible for ensuring:
- You have the right to upload your content
- It doesn't violate any law or third-party right
- You have consent from individuals in photos where required
- Customer information is entered with the customer's knowledge and consent
Photos
Photos are stored against job records, shared within your workspace, and may be shared with customers via secure link if selected. We don't use your photos for marketing or any purpose other than operating the Service.
Customer Data and Your Role as Controller
When you enter customer information into Tuizee, you are the data controller for that information. Tuizee acts as a data processor on your behalf.
This means:
- You are responsible for obtaining consent from your customers to enter their details
- You are responsible for handling your customers' access, correction, or deletion requests
- You indemnify Tuizee for any claims arising from customer data you've entered without proper consent
- Tuizee will still act on legitimate takedown requests from customers directly (see our Privacy Policy)
IPP3A notification: As the data controller for customer information you enter into Tuizee, you are responsible for notifying your customers that their personal information is being collected and entered into a trade management system, including the purpose, recipients, and their rights of access and correction under the Privacy Act 2020. This is a legal obligation under IPP3A (effective 1 May 2026). Tuizee is not responsible for notifying your customers on your behalf.
Customer Secure Links
- You can generate private secure links to share job information with customers
- Links are saved in the customer's browser and can be revoked or regenerated by you
- You are responsible for sharing links only with the intended customer
- We are not liable for unauthorised access from your sharing of links
Intellectual Property
The Service, including its software, design, branding, and technology, is owned by Digiconsult Ltd. Your User Content remains yours. Feedback you provide may be used by us without obligation.
Disclaimers
The Service is provided “as is” and “as available”. We don't guarantee uninterrupted or error-free access. To the maximum extent permitted by law, we disclaim all warranties. You are responsible for maintaining your own copies of your User Content.
Limitation of Liability
To the maximum extent permitted by law, our total liability to you arising out of or relating to these Terms or the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, business, or data.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Consumer Guarantees Act 1993 or any law that cannot be excluded.
Indemnity
You agree to indemnify Digiconsult Ltd, its directors, officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or relating to:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Customer data you enter without proper consent
- Photos you upload without appropriate consent
- Your failure to notify customers under IPP3A as required above
Termination
You can terminate your account at any time. We can suspend or terminate your account if you violate these Terms, fail to pay, or create risk or legal exposure.
On termination:
- Access ends immediately
- Data is retained for 90 days, then permanently deleted
- Customer secure links are revoked immediately
- Sections that should survive termination (including IP, indemnity, and limitation of liability) remain in effect
Dispute Resolution
If a dispute arises, the parties will first attempt good faith negotiation. If unresolved within 14 days, the dispute will be referred to mediation under the rules of the Resolution Institute (or another agreed mediator). Costs are shared equally. If unresolved through mediation within 60 days, either party may commence court proceedings in New Zealand.
Governing Law
These Terms are governed by New Zealand law. The parties submit to the exclusive jurisdiction of New Zealand courts.
Changes to Terms
We may update these Terms. We'll notify you of material changes by email or in-app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
